Hello everyone,

 

I work at the University of Toronto and am interested in this from the perspective of recruiting creators who will allow us to post their work under a Canadian Creative Commons license. I'm not a lawyer myself, and I wish to make this easy to understand for creators not well-versed in copyright law.

 

From the posting in the archive, I understand why the decision was made not to allow the creator to waive moral rights; and, if that decision holds, then I would like to better understand the mechanism for a creator to disavow moral rights stated in 4.f and also the rights stated in 4.g. For example, the stipulation that the work must not be associated with a product, service, cause or institution that is prejudicial to the Original Author’s honour or reputation.

 

In particular, would waiving moral rights (i.e. waiving 4f.) also have the effect of waiving the rights stated in 4.g, or would these require a some sort of explicit waiver beyond that?

 

To help answer such questions, I’m wondering if iCommons Canada could provide some sort of waiver form or template that a creator with these concerns could put on a web page to make it easy for licensees to make a specific request to the creator. This would indicate that the creator would be receptive to the request.
