And these two situations have various subcategories.

a) The more restrictive than BY-SA (MRTBS) work is allowed to be
included under the doctrine of fair use
b) The MRTBS work is allowed to be included because one has a license
c) The MRTBS work is restricted not by copyright but by a patent
d) The MRTBS work is restricted not by copyright but by trade secret law
e) The MRTBS work is restricted not by copyright but by trademark law
f) The MRTBS work is restricted not by copyright but by database rights law
g) The MRTBS work is copyright in some countries, but not the one of
the person incorporating it
h) etc. - I'm sure there are more
