"Someone mentioned that they are selling sunflower shoots and pea shoots that need to be kept cool..... Any suggestions on how to get the state to change or does anyone have a sense of whether getting the state to change is even possible?"
Sprout production falls under FEDERAL regulations, under the jurisdiction of the Food & Drug administration (as opposed to USDA which regulates most farm produce) so there is no chance whatsoever of relief.

The seeds for the Kroger sprouts are sanitized in a 20,000 ppm chlorine solution, the irrigation runoff from the sprouts sold at Kroger are run through a lab test for pathogens for every batch produced and the plant where they are produced meet local and state Health department and Federal FDA requirements for food processing, including a HACCP plan for the facility.
