You must have a sellers permit, and if you wash the herbs then you may need to be state inspected and/or have a processing license.  If you sell them as an agricultural raw product this may not be necessary- but most restaurants want food delivered to them that requires very little done to them- they just don't have the time to mess with dirty produce.  In the restaurant venue the more convenient it is for them to use the product, the more likely they will buy from you.  This includes having herbs destemmed and assembled into known quantities.  For this you will need a processing license- should be around $60 for you to get one and be inspected anually.  Good Luck!
