A three-
judge panel ruled that the CIPA -- which requires public libraries
receiving federal fundstoinstall filtering software on all public Internet
terminals -- is
unconstitutional.Filterware is a "blunt instrument"
according to the
court.

Excerpt:
"Government efforts to restrict access to online pornography
received another setback today when apanel of federal judges struck down a
law requiringpublic libraries to install Internetfilters to block access to
objectionable
sites.

"In a unanimous decision, the three judges of a special panel said the
Children'sInternet Protection Act is "invalid under theFirst Amendment"
because it
requireslibraries to use technology that blocks access tolegitimate sites on
the
World Wide Web,while still giving access to some pornsites."
