Thanks for that very clear explanation.

Obviously the government should be encouraged to change the Copyright
Act dealing with Crown Copyright so it is in the public domain (no
copyright protection)

A Crown copyright work can be licensed under Creative Commons in the
same way as any work can be licensed. Creative Commons relies on Part 5
of the Copyright Act which deals specifically with copyright licensing.
Following NZGOAL a work could show as "Crown Copyright (c) 2009,
licensed under a Creative Commons Attribution 3.0 New Zealand Licence."
or "Crown Copyright (c) 2009, some rights reserved".

What can't easily be done is apply a blanket licence to all Crown
Copyright works via one government agency, as there is no one agency
responsible for Crown copyright administration. Each agency would need
to individually adopt the practice being recommended by NZGOAL, and
licence the works they've created themselves.

Alternatively, the government could be encouraged to change the
Copyright Act dealing with Crown Copyright. It was raised at the Open
Government Barcamp in Wellington over the weekend as to why Crown
Copyright material in New Zealand is not public domain (no copyright
protection) like it is in the United States. In 1994 Crown Copyright
was extended from 50 years to 100 years, but I'm not familiar with the
rationale at the time.

I'm excited to announce that the draft version of the New Zealand
Government Open Access and Licensing framework (NZGOAL) has just been
released for public feedback. The release of NZGOALF is part of the Open
Government Information and Data Re-use Project led by the New Zealand
State Services Commission in partnership with, among others, the ICT
Group at the Department of Internal Affairs.

The framework will enable greater access to many public sector works by
encouraging State Services agencies to license material for reuse on
liberal terms, and recommends Creative Commons as an important tool in
this process.
