about 'free vs open'

we were talking about open source and 'free media' and all that.

an interesting point was raised by one - namely, that the CC approach is problematic because it deals with cultural objects under consideration as /objects/, as opposed to the License Art Libre (recommended by the GNU foundation over CC) which deals with cultural objects as objects embedded in /culture/.

in other words, while the CC licenses provide a convenient and effective means to help disseminate a particular piece of work, License Art Libre aims to enable pieces of work to foster and further a collective culture.

in other words, again, CC is about maintaining the essentially object-based view of art as objects, creating control via artificial scarcity; License Art Libre is about relinquishing this ability to create artificial scarcity without undermining your rights as the creator of the piece.

CC ShareAlike perhaps makes a CC license much more like a License Art Libre, but no-one uses ShareAlike anyway - they're all stuck on NoDerivs, wherever I look, even MP3s released by netlabels. strictly speaking a -NoDerivs licensed piece of music cannot be used in a podcast or dj set, for example.
