Catharina (from CC International, Berlin) will respond to this, and correct me if I am wrong, but that is correct, the CC process is to first find a project lead who is a respected legal scholar in a local institution.  That person signs a memorandum of understanding with CCI and there should then be a first draft of the legal translation.  A team will then be formed to do the translation and porting drafts (adaptation to the local laws), set up meetings and web site, and so on.  CC-HK should include users and technical people as well as lawyers, and pro bono legal help from local law firms is appreciated at that point.

So it sounds as if Professor Li will agree to join as project lead and discuss this with Catharina?  The project could then move forward on her timetable, considering her other current responsibilities.  But if she does not agree to the contract, then we must find another project lead to begin.  In any case, we should not do any of this ourselves, but Catharina will take the lead, and then it will be the job of the project lead with CCI.

In the meantime, as Jon suggested, it is possible for HK users to use the generic 3.0 CC licenses from http://www.creativecommons.org.  These are not the US licenses (which are now ported from these generic licenses) any more, but they are in English.

The work about the Copyright Initiative in HK should also go forward without considering CC; it is a motive for creating CC in HK, but CC should be done no matter whatever government action.

Bear in mind there is also a parallel group called iCommons, which has a summit meeting
in Dubrovnik, Croatia, June 15-17--see the CC web page for links--and it would be good if
representatives from HK as well as other places could confer there to discuss many common problems and solutions.

After the licenses are ported and published and launched, CC-HK will continue as an organization with many concerns such as sponsoring salons, dealing with collecting socities, listening to user needs, and so on.

If there is a problem with funding CC-HK activities, please let me know privately. And if you need help raising money from rich people in HK, for example to fund iCommons scholarships, I would be glad to help.

The actual launch of the licenses in about six months is a great celebration--I look forward
to that, but I will try to come down to HK from Shanghai this summer to meet all of you first. You show real enthusiasm and team spirit and this is all a great pleasure to me as a co-founder of Creative Commons, now living in China.

Yesterday, I had lunch with Ms. Rebecca Ong, a Teaching Fellow of City University and specialize in IP law.  Rebecca expressed her interests to help.  This is a great news to would be HK-CC.  We have law faculty members from both HKU (Yahong) and City U (Rebecca Ong), as well as support from HKU journalism dept (Rebecca MacKinnon) and UST technology transfer centre (Matthew).  It is a very good start.

  1. Create drafts for the six Ver 3.0 Licenses (http://creativecommons.org/licenses/ ) for HK use.  This effort will be championed by the institution, and supported by other academics and anyone who are willing to help.  I will not count on private sector lawyers on this stage unless they are volunteering their valuable time.

 

  1. Solicit comments for the drafts.  We will seek private sector lawyers' help, may be even help from DOJ and IPD.

 

  1. Repeat (1) and (2).

 

  1. Send the drafts to Creative Commons for review.

 

  1. Translate the drafts into Chinese.

 

We may want to swap the sequence of step 4 and 5 if necessary.  What does everyone think?

 

I will also like to propose to have a face-to-face meeting soon.  I bet the ideal place would be a classroom in HKU, City U or UST.

 

Let's kick start HK-CC ASAP!

We (Jon, Prof. Yuen's team and I) had a meeting back in early 2006, but not recently.  No translation has started.  I am fully engaged in this May and June, and will be available for meeting, if there is one, only in July and August.
