Your question does not contain enough "facts" to answer it - not even as a hypothetical.  The short answer is that copyright law (in France or Australia) does not provide the answer to your question.  It is a matter that involves a different body of law, which would also have to be taken into account.  I realise that you are not a lawyer, so you would not be aware of the operation of private international law in this context.

Perhaps if you could provide some further details it would then make sense to attempt to answer your hypothetical.
