Para um melhor enquadramento da versão 3.0 das licenças Creative Commons, sugerimos a leitura dos seguintes documentos:

(ii) Documentos de suporte aos CC Legal Leads (Checklist, Working Document, Collecting Societies Matrix, Database Rights), disponíveis em http://wiki.creativecommons.org/Versioning_to_3.0.

As questões que lançamos para a discussão são as seguintes:
1. Concorda com o termo proposto “Apresentar ao Público”? Se não concorda, sugira o termo português que considera mais adequado para traduzir o termo “Publicly Perform”. Atente que tal termo deverá incluir tanto o direito de comunicação pública como o direito de colocar à disposição do público. Explique.
2. Concorda com o termo proposto “Compilação”? Se não concorda, sugira o termo português que considera mais adequado para traduzir o termo “Collection”. Explique.
3. Concorda com o termo proposto “Titular originário”? Se não concorda, sugira o termo português que considera mais adequado para traduzir o termo “Original Author”. Atente que tal termo deverá incluir tanto o titular de direito de autor (incluindo o próprio autor) como o titular de direitos conexos. Explique.
4. Concorda com o termo proposto “Trabalho”? Se não concorda, sugira o termo português que considera mais adequado para traduzir o termo “Work”. Atente que tal termo deverá incluir tanto as obras do domínio literário, artístico ou científico objecto de direito de autor como as prestações objecto de direitos conexos. Explique.
5. Concorda com o termo proposto “Obra Derivada”? Se não concorda, sugira o termo português que considera mais adequado para traduzir o termo “Adaptation”. Explique.
6. Concorda com a definição proposta para o termo “Reprodução”? Se não concorda, sugira a definição que considera mais adequada. Explique.
7. Concorda com a implementação da cláusula 4(f), atinente aos direitos sujeitos a representação institucional (obrigatória e voluntária), proposta? Se não concorda, sugira a implementação que considere mais adequada. Explique.
8. Concorda com o reconhecimento dos direitos morais do artista intérprete ou executante proposto na cláusula 4(g)? Explique.
9. Concorda com o aditamento da cláusula 7(3), proposto de forma a clarificar que o autor pode a todo o tempo exercer o seu direito moral de retirada da obra de circulação? Explique.

This list was created to allow the public discussion of the BY-NC-SA 3.0 Portugal license draft.

The Portuguese and English versions of the license, as well as a summary of the substantial changes proposed by the legal team, are available at http://wiki.creativecommons.org/Portugal/3.0/BY-NC-SA/Draft.

For background information in respect to Creative Commons 3.0 Version Licenses, we suggest you to read the following documents:
(i) “Creative Commons Version 3.0 Licenses – A Brief Explanation”, by Mia Garlic, available at http://wiki.creativecommons.org/Version_3;

The questions we put on the discussion are the following ones:
1. Do you agree with the proposed term “Apresentar ao Público”? If you do not agree, please suggest the Portuguese term that you consider to be more accurate to replace the term “Publicly Perform”. Please note that such term should include both the right of public communication and the right of making available to the public. Please explain.
2. Do you agree with the proposed term “Compilação”? If you do not agree, please suggest the Portuguese term that you consider to be more accurate to replace the term “Collection”. Please explain.
3. Do you agree with the proposed term “Titular originário”? If you do not agree, please suggest the Portuguese term that you consider to be more accurate to replace the term “Original Author”. Please note that such term should include both the author’s original rightsholder (including the author, as the intellectual creator of the work, itself) and the neighbouring rightsholder. Please explain.
4. Do you agree with the proposed term “Trabalho”? If you do not agree, please suggest the Portuguese term that you consider to be more accurate to replace the term “Work”. Please note that such term should include both the works in the literary, artistic or scientific domains that are subject to author’s right and the works subject to neighbouring rights. Please explain.
5. Do you agree with the proposed term “Obra Derivada”? If you do not agree, please suggest the Portuguese term that you consider to be more accurate to replace the term “Adaptation”. Please explain.
6. Do you agree with the proposed definition of the term “Reprodução”? If you do not agree, please suggest the definition that you consider to be more accurate. Please explain.
7. Do you agree with the implementation of clause 4(f), which refers to the rights subject to voluntary/mandatory institutional representation? If you do not agree, please suggest the implementation that you consider to be more accurate. Please explain.
8. Do you agree with the proposed recognition of the moral rights of the performer in clause 4(g)? Please explain.
9. Do you agree with the proposal of adding clause 7(3), in order to clarify that the author can, at any time, exert the right of withdrawal? Please explain.
