Sunworld is very contract oriented and only deals
with commercial growers, many in foreign countries. If you happen to get one of
their varieties after the patent has expired you can propagate as you wish with
no recourse on their part. I realize that they can try to find out where it
escaped from but you are under no obligation to tell them. I understand that
they are just trying to protect their investment in the breeding of the plant
but that is the reason for the patent limit. They are supposed to make their
profit before it expires. The old patents were good for 17 years but plant
patents since 1995 are good for 20 years.
