There is a thing called a common-law trademark. You name something and get
the name into print with the "tm" trademark symbol on it. Note that it is
lower case. If it's upper case ("TM") then it has to be a trademark that is
registered with the copyright office to make it official. Anyway, with a
common-law trademark, the trick is to get your variety so well known by that
name that anyone who steals and re-names the variety has to completely
re-advertise it. It's tricky, but do-able if you are a good publicist.
