That's the connection speed which is not the same as data transfer speed. In
a perfect world they'd be the same but your connection is taking care of all
sorts of housekeeping chores while it is transfering data, also if the
connection isn't ideal, the packets of info fail checksum and are constantly being
resent.
I'm on the ragged edge digital backwater with technically 56K dialup whose
first 3000' feet to the utility line is as dubious as it comes. That actual
connect speed is between 40K and 48K and the data transfer speed is typically
4kbs.
