Damages would be recoverable from the operator of the drone under Common Law. However, you would have to identify the operator and he would have to have some financial resources to obtain a judgement against. There may also be some criminal charges available if the action was considered assault on a police animal or harassment. This would require a specific statue, and again identifying the perpetrator. Criminal actions require a higher degree of proof than civil. Pennsylvania has a police animals law in the state criminal code: 18PA5511.2 which potentially makes the action a third class felony. Knowledge of the consequences of your actions is not required to be charged. Irv Lichtenstein |
