[permaculture] public domain...patentable???

The big companies have tried before. Somebody tried to patent Basmati rice in India.? I think it was Monsanto, but I am not positive.? They lost their but they may keep trying and who knows they could succeed here with the current Supreme Court.

The discussion of patents and heirlooms is puzzling and I'm trying to 
gain clarity.  Is it actually possible to take what would seem to be in 
the public domain and actually patent it...such as an heirloom variety???
