San Antonio court ends monkey battle

SAN ANTONIO — An appeals court ruled that six retired research
chimpanzees from Ohio State University will remain at a Louisiana
sanctuary, ending a nearly three-year legal battle.
The Fourth Court of Appeals dismissed a lawsuit Wednesday by Primarily
Primates that would have forced Chimp Haven of Shreveport, La., to
return the animals. Chimp Haven is also known as The National
Chimpanzee Sanctuary.
The chimpanzees were brought to Louisiana in November 2006 after the
state of Texas seized the San Antonio facility, Primarily Primates,
and placed it in receivership. When the receivership was finished,
Primarily Primates sued to get the animals back and received a
favorable ruling from the Bexar County district court.
The appeals court said the Bexar County district court did not have
jurisdiction to make that ruling, the San Antonio Express-News
reported in its online edition Wednesday.
Primarily Primates President Priscilla Feral said the sanctuary would
not pursue the matter any more and the monkeys can remain in
Louisiana.
