I too think that BY should be part of a freeware/FOSS license.

IMHO, the problem with the BY part in the old BSD license was that it 
was too specific about the ways that contributors had to be listed.

I think that it's enough if a BY license states that the contributor 
list must always be easy to inspect. It need not be prominent, and it 
need not be repeated in every file.
One *could* also request an honest attempt at ranking the contributors 
by relevance. Such a clause should be no more than advisory though - 
it's too difficult to rank such a thing as "relevance" in a way that 
will hold up in court.
