I think that's a difficult exception to make legally binding,
and not create any future loophole. But more importantly,
if Dave is open minded enough to allow anyone to apply
his DRM to outside content, then Dave probably would
have been open minded enough to design his hardware
platform to simply play non-DRM'ed open format content.
And if a platform plays non-DRM'ed open format content,
then the anti-TPM clause is not a hindrance to Alice and
Bob enjoying their content.
Given that simple, straightforward design option, versus the
potential for for creating a future loophole from some
very complex legal language, I'd go with the simple option,
keep the anti-TPM, and any platform that is open minded
enough to play non-DRM, open format content gets to
play the content.
