The MIT/OCW CC license does have a noncommercial clause
(http://ocw.mit.edu/OcwWeb/Global/terms-of-use.htm). That's why "they

This is an interesting assertion, and one which might require an
adjustment of the language of the license. If the students are
affiliated with an institution but the tutor is not, then it would be
legal for the students to use the materials but not the tutor. So
perhaps the language should be altered to focus on facilitating the
learning of students associated with an institution (and not teaching).
This would allow community center volunteers, etc., to use materials
legally with students.
However, your tutor might be discounted from using MIT and other
standard cc licensed materials already by the noncommercial clause, in
which case cc.edu wouldn't be a separate issue.
