Care to give a few links to such files? I know I have run across things on 
Jamendo in the past where the license listed on the album page did not match 
the license in the metadata of the downloaded tracks. IIRC, I think it was 
explained as a case where the copyright holders changed the license for the 
album but the track metadata did not get updated as it should have. I do not 
know if that have swatted this problem.
