One would assume that a reputable stock agency will have already done 
that. After all that is one reason why you are using the agency and not 
dealing with the photographer directly. The problems comes when you 
source the images directly from flickr etc. wikimedia commons call it 
"flickr washing"

In many cases the kids are thinking that everything on the internet is 
'public domain' and just apply the most liberal license on everything 
they hoover up. So basically if you are sourcing images from sites like 
flickr then you may well find yourself up the creek without a paddle 
when the real copyright owner comes calling.
