Does anyone have any use cases for non-commericial use of online video content.
Specifically, if a content owner makes embedding code available and has CC NC license, can this code be embedded into a web page that has advertising (google adsense, sponspors, etc.). I always ask permission directly from the content owners just to CMA, but I am really curious as to what non-commericial means.
Some old media examples would be using a photo in an editorial format where there are ads in the newspaper. Using a video to report news on a TV news cast that has advertising interludes. Versus selling a video or picture(s) on a CD, for example, which would be a direct commercial benefit.
How is this NC defined legally in the US? Does their have to be an overt commericial benefit for providing access to the work, where access is denied without this benefit? Or does the existance of advertising on the same page consistitue commercial use?
I realize there is no clear definition just want to see some real life examples.
