Is it the case that you could use the newer license on the derivative today if 
you had only just made it instead of having made it in the past?

If so, then the license should allow the old derivative to be placed under the 
new license. Anything else would be a bug in the license from my point of 
view.

I will wait to hear what others say before commenting further.
