Hi,
I'm writing from WFMU (wfmu.org out of Jersey City, NJ, USA) where we're
gathering music for a new website we're developing called the Free Music
Archive (http://freemusicarchive.org). We're asking contributing artists to
license their material under Creative Commons, and we want material on the
FMA to be legally available worldwide.
We know that there are slight variations in the legal code for each ported
license, but we're a little confused about the porting process. We've been
using a US-ported license (
http://creativecommons.org/licenses/by-nc-sa/3.0/us) as our default, since
we're based in the US. Does this automatically cover us in all other
jurisdictions where the license has been ported? If not, how would we do
this?
As we begin to approach international artists, our legal advisers suggested
that we use both a cc-U.S. license and a license for the artists' home
country, if not also a license for the country where the composition was
published and/or the recording released. If this is true, would we then want
to tag these files with URIs for the int'l license(s), in addition to the US
version?
Somewhat related question: is there any reason to consider using an unported
license, or is that less like to hold up across specific jurisdictions?
Here's some previous discussion:
http://lists.ibiblio.org/pipermail/cc-community/2007-December/002874.htmlwhich
eventually clarifies that there is a difference between the
translation of each license and the porting.
Thanks for any advice you can offer
-Jason
