I want to just point out that it's not just gratis/non-gratis that's at 
stake here - the Nine Inch Nails license allows derivatives (and 
republication of those derivatives) and downstream subderivatives.

You could very easily draw a spectrum of:

R.E.M.: Most liberal licensing (even if by a weird one for content)

Nine Inch Nails: by-nc-sa allows derivatives

Radiohead: Gratis (or your choice of price) music, but no license to 
empower fans.

So the R.E.M. license is definitely the most interesting from a Free 
Culture perspective, but calling the NiN release just gratis/non-gratis 
ignores the difference beween this release and the Radiohead release.
