The DMCA "safe harbour provisions" exist, because both courts, and IT
specialists agree that it is unreasonable to require an organization
to vet all content for possible copyright violations, prior to making
it available, when that content is uploaded by third parties.
Where Copyright law falls down, is that only the copyright owner, or
their authorized representative may legally advise the organization
hosting the material that there is a copyright violation.
Google is working on technology to determine whether or not two images
are the same. As such, they may have the initial workings of a bot
that seeks out, and removes copyright material on their website. In
theory, it can be expanded to included videos.

The issue for Google etc, is how to know whether or not the clip
labeled "One night in Paris" is from the video released by Paris
Hilton, or Joe Sixpack's home movie about a bar fight Paris, Kentucky.

The worst offenders in terms of providing such material are not based
in the United States. As such, the DMCA doesn't apply to them.
