[cc-community] Contradictory meanings of "non-commercial"?

Which is my point. The guidelines have no legal weight. The license  
does. CC makes very clear that they are not a law firm, therefore  
their advice is meaningless.

They also preface the document with the following phrase:

> These guidelines are a discussion draft only. They are not finalized  
> and they do not represent a definitive explanation of what  
> "NonCommercial" means, in particular they do not represent a  
> definitive statement as to what Creative Commons defines  
> "NonCommercial" to mean.

So, I don't see how good or bad ethics can play a part here. Playing  
ignorance only works so far.
