In France where some of the exceptions and limitations to exclusive
rights are really narrow, even a CC NC ND brings substantial
additional freedom, it is really a 'fair use plus' license.
Besides, on a negotiation point of view, it is less difficult to have
traditional institutions or authors adopt this license as a first
step, and nothing prevent them to switch to more liberal terms after
they experienced by themselves.
We saw the case of a local public authority which changed from BY-NC
ND to BY-SA after realizing it was too burdensome to answer to all
the requests for commercial uses and not useful to reserve these rights.
