Here's a related case to ponder...
As another datapoint, I once paid for a set of house plans, and the
contract (or license?) that came with it said that the plans could be
copied as many times as I needed (I paid more for that privilege), but
that the plans could only be used to build ONE house. So, for example,
if I wanted to build a whole housing development based on the plan, I
would have to pay for more licenses.
Was that requirement legally enforceable?
If it is legal, it seems to support the idea that the right to
manufacture objects from a design requires a license and that therefore,
a copyleft requirement can be made on that basis.
I don't know if it matters, but I am in the US, and the architect was in
Canada.
