You have two professors working for different institutions of higher learning.

Neither is a volunteer professor, both are paid. That is, they both earn their 
living by teaching.

Both courses have regularly licensed text books.

Both professors tend to occasoinally supplement their course materials with 
bits and pieces they come across. They pay for these materials out of their 
own pockets where needed.

Can they use BY-NC materials in this supplementary fashion?

Do you need to know if the institution where they teach is for profit or not 
in answering the above question?

BTW - personally, I am not trying to wriggle out of anything. I have long ago 
made the personal decision not to give the time of day to NC licensed works.
