[cc-community] My photo was used in the magazine / licensing question

I just recieved a new issue of one magazine I'm
subbscribed to, and there's a photo from my Flickr
account.

The licence I have on it on Flickr is
Attribution-Noncommercial-Share Alike 2.0 Generic -
creativecommons.org/licenses/by-nc-sa/2.0/deed.en-us

There are two places they gave credit to me, to my
Flickr nickname: (a) in the footer of the page where
photo is published (they even misspelled it there),
and (b) on the page where they list everyone who
worked on the magazine issue, in the Photographs
section along with others. There are a couple more
nicknames from Flickr, the rest are normal human
names.

It was listed as "MyNickname / Flickr".

My questions are:
(1) are they allowed to use the photo in their
magazine with the license I had selected? even by just
crediting me by my nickname/webservice?
(2) are they allowed to use a photo of a person who
can easily be recognized on that photo without that
person's permission/release form? even with that
license selected? (this one probably has nothing to do
with CC licensing, but maybe sombody here knows
anyway)

P.S. the magazine's headquaters and the photographer's
residence are both in USA, in the same state.
