[cc-community] CC and collection societies. Possible? Sensible?

Here is an off the wall thought I had. I am not sure how it should go or how 
to word things properly as far as I have thought this through.

Something like this:

Despite this CC license, if you have an existing agreement or enter into an 
agreement with a collection society [which does not allow artists to specify 
exceptions on particular works,] you may not avail yourself of this license 
but must treat it as any other ARR work and pay the society for its use in 
those instances where you would owe the society for such use.

[] perhaps leave the part in brackets out completely.

I don't like this, but could it fit with a Free philosophy(with refinements?) 
and could it work at least on a temporsry basis?
